Welcome to Visa Album (the "Service," "Platform," or "Software"). These Terms and Conditions ("Agreement" or "Terms") constitute a legally binding, comprehensive contract between VARGA ISTVÁN BERTALAN – Sole Proprietor ("we," "us," "our," or the "Company") and you, the user ("User," "you," "Customer," or "Agency").

By registering for an account, accessing the Service at visaalbum.com or lovevisa.eu, uploading any media, purchasing a subscription, or utilizing any of our proprietary tools (including our Layout Engine and AI Audit), you acknowledge that you have read, understood, and agreed to be unequivocally bound by this Agreement. If you do not agree to all the terms and conditions outlined in this Agreement, you are strictly prohibited from using the Service and must immediately cease all access.

AGE RESTRICTION: You must be at least eighteen (18) years of age to use this Service. By creating an account, you represent and warrant that you are of legal age to form a binding contract and meet all eligibility requirements.

1. THE SERVICE: NATURE, SCOPE, AND LEGAL DISCLAIMER

Visa Album operates as a specialized "Software as a Service" (SaaS) micro-platform. It provides high-tech formatting, chronological organization, and design tools tailored for the creation of relationship evidence dossiers (e.g., for Schengen, UK, USA K-1/CR-1, and Australian partner visas).

1.1 LEGAL DISCLAIMER

We are strictly a software and technology provider. We are NOT a law firm, immigration consultancy, embassy representative, or government agency. We do not provide legal advice, legal opinions, case-specific immigration strategies, document translation services, or guarantee the success of any visa application.

1.2 NO ATTORNEY-CLIENT RELATIONSHIP

Your use of the Service—including any communication with our customer support team, consumption of our blog content, or utilization of our AI-generated feedback and "Magic Wand" tools—does not, under any circumstances, create an attorney-client relationship or a fiduciary duty.

1.3 USER SOLE RESPONSIBILITY

The ultimate responsibility for the legal sufficiency, factual accuracy, formatting compliance, and truthfulness of any document produced using the Service rests entirely with you. Immigration guidelines are subject to sudden, unannounced changes. It is your sole responsibility to cross-reference your generated PDF dossier against the most current formatting and evidentiary requirements of your specific target embassy or consulate prior to submission.

1.4 EXPORT AND PRINTING LIMITATIONS

Our platform utilizes an html-to-image rendering engine to maintain strict A4 sizing. However, we are not responsible for variations in print quality, color accuracy, or physical margins caused by your local printer hardware, outdated web browsers, or third-party PDF viewing software.

2. AI AUDIT, MAGIC WAND, & NARRATIVE TOOLS

The Service incorporates advanced features powered by third-party Large Language Models (LLMs) and computer vision technologies, including OpenAI Vision (collectively, "AI Tools," "AI Audit," or "Magic Wand").

2.1 STYLISTIC SIMULATION ONLY

The AI Audit is a visual and stylistic simulation intended solely to identify formatting gaps (e.g., detecting empty image placeholders) and assess general narrative consistency. It compares low-resolution screenshots of your layout against a "Text Cheat Sheet" of your captions. It is NOT a legal compliance check, nor is it a substitute for human legal review.

2.2 PROBABILISTIC OUTPUT & HALLUCINATIONS

You explicitly acknowledge that AI technology is inherently probabilistic and experimental. The AI Tools may "hallucinate," generate entirely fictitious timelines, misidentify the individuals in your photographs, or fail to identify critical missing evidence. A high "Score" (e.g., 9/10) or a "Checkmark" from the AI Audit is provided strictly for organizational gamification and peace of mind; it is not a statistical prediction or endorsement of visa success.

2.3 MANDATORY FINAL REVIEW

You are strictly required to independently review every generated caption, date, image placement, and layout structure before finalizing your dossier. We assume zero liability for any errors, omissions, offensive text, or misrepresentations introduced by, or missed by, the AI Tools.

2.4 THIRD-PARTY PROCESSING

By using the AI Tools, you consent to the transmission of your textual inputs and low-resolution page screenshots to our third-party sub-processors (e.g., OpenAI) for the sole purpose of generating the requested audit or caption.

3. ACCOUNTS, SUBSCRIPTIONS, & VIRTUAL CREDITS

3.1 ACCOUNT TYPES

Access to the Service is granted via fixed-term "Passes" (e.g., 14-day Free Preview, 84-day Standard, 365-day Premium) or recurring "Subscriptions" (e.g., Agency Partner, Partner Plus).

3.2 CREDIT USAGE, ALLOCATION, & EXPIRATION

• Subscription & Pass Limits: Your access tier strictly dictates your resource limits (e.g., maximum Albums, maximum Global Media Library photos, and AI Audit credits). For recurring Agency plans, base limits reset at the exact start of each billing cycle. Unused base credits do not roll over to the next cycle under any circumstances.
• One-Time Add-Ons: Credits purchased as "Add-ons" (e.g., Expansion Packs, Audit Refills, Storage Boosts) do not expire as long as your underlying account remains active. Our database logic automatically prioritizes and exhausts expiring Subscription Credits before deducting from your purchased Add-on balances.

3.3 ACCOUNT SECURITY & SHARING

You are entirely responsible for maintaining the confidentiality of your login credentials, including secure management of SMTP Magic Links and Google OAuth access. Sharing a Personal Access Pass login among multiple, unassociated couples is strictly prohibited. We are not liable for any unauthorized access, malicious data deletion, or data breaches resulting from your failure to secure your account or email inbox.

4. PAYMENTS, BILLING, REFUNDS, & AFFILIATES

4.1 FINAL SALE POLICY

Due to the immediate digital nature of the Service, the instant allocation of secure server infrastructure, and the non-recoverable consumption of third-party AI computational resources upon your use, all sales are final. We do not offer prorated refunds for unused time, ungenerated PDFs, or unused credits on Passes or Subscriptions.

4.2 EXPRESS WAIVER OF RIGHT OF WITHDRAWAL (EU USERS)

By clicking "Purchase," "Pay," or otherwise completing a financial transaction on our Stripe checkout, you provide your express prior consent for the performance of the contract to begin immediately. YOU EXPLICITLY ACKNOWLEDGE AND AGREE THAT YOU THEREBY WAIVE AND PERMANENTLY LOSE YOUR 14-DAY RIGHT OF WITHDRAWAL provided by EU Directive 2011/83/EU once the digital content is accessed, the dashboard is unlocked, or credits are provisioned to your database record.

4.3 INVOICING & AUTOMATION

All purchases are automatically invoiced via our integration with Szamlazz.hu. You are responsible for providing accurate billing information. Invoices are generated based on the data provided at checkout and cannot be retroactively altered for tax evasion purposes.

4.4 CHARGEBACKS

We treat unauthorized credit card chargebacks as hostile, fraudulent activity. Initiating a chargeback will result in the immediate, permanent termination of your account, the irreversible deletion of your dossiers, the blacklisting of your payment method, and the potential pursuit of recuperation costs through collections agencies.

4.5 COUPON ABUSE

Abuse of the dynamic coupon engine (e.g., attempting to stack non-stackable percentage discounts, sharing restricted 100% override codes) will result in immediate account termination.

5. SERVICE AVAILABILITY, CLOUD SYNC, & DEADLINE LIABILITY

5.1 "AS IS" AND "AS AVAILABLE"

The Service is provided strictly on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

5.2 CLOUD SYNC & DEBOUNCING RISKS

Our platform utilizes "Smart Debouncing" (e.g., a 1-second delay) for text fields in trip logs and captions to protect our database. If you type rapidly and immediately close your browser window or lose internet connection before the cloud sync completes, data loss may occur. We are not liable for unsaved data resulting from connectivity issues or browser termination.

5.3 NO UPTIME GUARANTEE & DEADLINE RESPONSIBILITY

Visa applications involve incredibly strict, non-negotiable government deadlines. You explicitly agree that you will not wait until the final 48 hours before a deadline to generate, audit, or download your PDF dossier. We assume absolutely zero liability if a server outage, layout bug, or scheduled database maintenance prevents you from accessing, rendering, or downloading your documents in time for an embassy appointment, interview, or mailing deadline.

5.4 FORCE MAJEURE

We shall not be held liable for any failure or delay in performance due to circumstances beyond our reasonable control. This includes acts of God, natural disasters, war, terrorism, catastrophic third-party infrastructure outages (e.g., Next.js, Vercel, Supabase PostgreSQL, OpenAI, Stripe), internet service provider regional failures, or governmental embargoes.

6. DATA PRIVACY, SENSITIVE CONTENT & GDPR COMPLIANCE

6.1 GENERAL COMPLIANCE

As a Hungarian entity, we process personal data in strict accordance with the General Data Protection Regulation (GDPR). Please refer to our separate Privacy Policy for comprehensive details regarding your rights to access, rectify, and erase your data.

6.2 EXPLICIT CONSENT FOR SPECIAL CATEGORY DATA (ARTICLE 9)

By utilizing the Service to compile a relationship dossier, you will undoubtedly be uploading highly sensitive personal information. This may include, but is not limited to, data revealing racial or ethnic origin, religious beliefs, sexual orientation, intimate chat logs, and biometric visual data ("Special Category Data"). By actively checking the mandatory consent box during registration and uploading this content to our servers, you provide your explicit, informed, and unambiguous consent for us to store and process this Special Category Data for the sole technical purpose of rendering the Service to you.

6.3 GLOBAL MEDIA LIBRARY & HASHING

Every image uploaded to our secure Supabase Private Buckets is mathematically hashed (SHA-256) to prevent redundant storage uploads. This process is entirely automated. You retain all intellectual property rights and copyrights to the images and text you upload. We claim no ownership over your relationship history. We strictly do not sell your photos or use your private dossier data to train our own, or third-party, foundational AI models.

6.4 CROSS-BORDER TRANSFERS

You acknowledge that while we are EU-based, our sub-processors (e.g., OpenAI, Stripe) may process encrypted data fragments on servers located in the United States. Such transfers are safeguarded by Standard Contractual Clauses (SCCs) or equivalent legal frameworks.

7. DATA RETENTION, ACCOUNT PURGING & LIFECYCLE

7.1 ACTIVE PASSES

While your Pass or Subscription is active and in good standing, your media, AI Audit thumbnails, and generated PDFs are securely stored and accessible via signed, short-lived URLs.

7.2 DORMANT ACCOUNTS & DATA DELETION

Upon the expiration of a Personal Access Pass, your account enters a "Dormant" state. In a Dormant state, you lose layout editing privileges, PDF generation capabilities, and access to high-resolution exports.

7.3 ROUTINE PURGING

To comply with GDPR data minimization principles and manage our cloud infrastructure, we reserve the right to permanently and irreversibly delete all uploaded media, generated PDFs, trip logs, and user data ninety (90) days after an account becomes Dormant. Temporary data, such as audit-thumbnails generated for the AI tool, may be purged on an even shorter cycle. We are not liable for any data, memories, or evidence lost due to this routine, automated purging process. You are entirely responsible for downloading and backing up your final PDFs to your local hardware prior to your Pass expiration.

7.4 SURGICAL DATA RESET

If you utilize the platform's "Reset Data" feature to purge specific billing or trip information, you acknowledge that this action is immediate and irreversible.

8. AGENCY, IMMIGRATION FIRM, & PROFESSIONAL USE

If you are an immigration professional, lawyer, consultant, or agency utilizing the "Agency Partner" or "Enterprise" tiers to manage third-party clients:

8.1 CONTROLLER-PROCESSOR RELATIONSHIP

You explicitly acknowledge that under GDPR, you act as the "Data Controller" for your clients' information, and VARGA ISTVÁN BERTALAN acts strictly as your "Data Processor."

8.2 INCORPORATION OF DPA

By using the Service on behalf of a client or inviting them via the Secure Client Portal/Impersonation System, you agree to our standard Data Processing Agreement (DPA), which is hereby incorporated by reference.

8.3 CLIENT CONSENT & SANDBOX RULES

You warrant, represent, and guarantee that you have obtained all necessary, explicit, and legally binding written consents from your clients to process their Special Category Data through our specific platform. Furthermore, you are responsible for ensuring your clients abide by these Terms while operating within their restricted Role-Based Sandbox.

8.4 PROFESSIONAL INDEMNITY

You agree to fully indemnify, defend, and hold harmless VARGA ISTVÁN BERTALAN from any and all claims, lawsuits, regulatory fines, or damages brought by your clients or data protection authorities arising from your failure to secure proper consent, your provision of poor legal advice, or your misuse of the Service.

9. PROHIBITED CONDUCT & ACCEPTABLE USE

You are strictly and unequivocally prohibited from:

• Using the Service to manufacture fraudulent evidence, forge "sham" relationship documents, manipulate metadata, or create materially false statements intended to deceive immigration authorities, embassies, or border control.
• Uploading any illegal content, including but not limited to Child Sexual Abuse Material (CSAM), non-consensual intimate imagery (revenge porn), or copyrighted material for which you do not own the rights.
• Attempting to reverse-engineer, decompile, maliciously scrape, or hack the Layout Engine, the Next.js API Routes, the Supabase PostgreSQL database, or the Stripe payment gateways.
• Attempting to bypass credit limits, manipulate the frontend DOM to unlock premium layouts without payment, or abuse the free trial/coupon system via disposable email addresses.
• Engaging in "account stuffing" by sharing generic login credentials across multiple unassociated couples to avoid paying for Expansion Packs. (Agencies must use the designated Collaboration and Impersonation tools).

Violation of any provision in this section will result in the immediate, unappealable termination of your account without refund, a permanent IP ban, and where applicable, reporting of your activities and IP logs to relevant law enforcement or international immigration authorities.

10. NO GUARANTEE OF OUTCOME & LIMITATION OF LIABILITY

10.1 ZERO LIABILITY FOR REJECTION

You explicitly and voluntarily agree that Visa Album is in absolutely no way responsible for the rejection, delay, denial, or Request for Evidence (RFE) regarding any visa, green card, or immigration application. Visa decisions are entirely subjective, inherently unpredictable, and made by sovereign government officers based on complex geo-political factors, background checks, and relationship merits that are completely outside of our control or knowledge.

10.2 EXCLUSION OF CONSEQUENTIAL DAMAGES

To the maximum extent permitted by applicable law, in no event shall VARGA ISTVÁN BERTALAN, its suppliers, or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages. This sweeping exclusion includes, but is expressly not limited to: loss of visa application fees, exorbitant immigration lawyer fees, lost flight/travel/relocation costs, lost wages, loss of immigration status, deportation costs, emotional distress, or loss of consortium resulting from a separated family due to a visa denial or delay.

10.3 LIABILITY CAP

To the maximum extent permitted by Hungarian and EU law, our total cumulative, aggregate liability to you for any and all claims arising out of or relating to this Agreement, your use of the Service, or data breaches, shall be strictly limited to, and shall not exceed, the total monetary amount you paid directly to us in the six (6) months immediately preceding the event giving rise to the initial claim.

11. TERMINATION & SUSPENSION

11.1 TERMINATION FOR CAUSE

We reserve the right to immediately suspend or permanently terminate your account, IP access, and data, without prior notice or refund, if we determine, at our sole and absolute discretion, that you have breached any provision of this Agreement, engaged in fraudulent activity, or posed a security risk to the platform.

11.2 TERMINATION WITHOUT CAUSE

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, or terminate your access for any business reason, at our sole discretion. In the rare event of termination without cause for a user with an active, paid Pass/Subscription in good standing, our sole obligation will be to provide a prorated refund for the unused time or credits remaining on the account.

12. INDEMNIFICATION

You agree to fiercely defend, indemnify, and hold harmless VARGA ISTVÁN BERTALAN, its contractors, licensors, employees, and affiliates, from any and all claims, damages, obligations, losses, liabilities, costs, or debt (including but not limited to reasonable and actual attorney's fees) arising directly or indirectly from:

(i) your use of and access to the Service; (ii) your violation of any term, condition, or representation within this Agreement; (iii) your violation of any third-party right, including copyright, intellectual property, or privacy right; (iv) any claim that your uploaded content caused damage to a third party; or (v) any allegation that documents generated via our Service were used in the commission of immigration fraud or perjury.

13. GENERAL PROVISIONS: SEVERABILITY, WAIVER, & ENTIRE AGREEMENT

13.1 SEVERABILITY

If any provision of this Agreement is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions of this Agreement will remain in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.

13.2 NO WAIVER

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by VARGA ISTVÁN BERTALAN.

13.3 ENTIRE AGREEMENT

These Terms, together with our Privacy Policy and any applicable Agency DPA, constitute the entire, complete, and exclusive agreement between us regarding our Service, superseding and replacing any prior agreements, oral or written, we might have had between us regarding the Service.

13.4 ASSIGNMENT

You may not assign or transfer your rights or obligations under these Terms, by operation of law or otherwise, without our prior written consent. We may freely assign our rights and obligations under these Terms to an affiliate or in connection with a merger, acquisition, corporate reorganization, or sale of assets.

14. GOVERNING LAW & JURISDICTION

14.1 JURISDICTION

This Agreement, and any dispute, controversy, or claim arising out of or in connection with it, or the breach, termination, or invalidity thereof, shall be governed by and construed strictly in accordance with the laws of Hungary, without regard to its conflict of law provisions.

14.2 DISPUTE RESOLUTION

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Service shall be instituted exclusively in the competent courts located in Budapest, Hungary. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

14.3 ODR PLATFORM

Consumers residing in the European Union may also submit complaints to the European Commission’s Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr/.

15. MODIFICATIONS TO TERMS

We reserve the right, at our sole discretion, to modify, update, or replace these Terms at any time to reflect changes to our practices, technologies, or legal requirements. If a revision is material, we will provide at least thirty (30) days' notice via a dashboard notification, an alert within the Service, or an email to the address associated with your account prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you irrevocably agree to be bound by the revised terms.
